3. Please note that to process your requests for these services, you may be charged a fee to send and receive messages based on the terms of your wireless service. Standard messaging charges apply. All charges are billed by and payable to your mobile service provider. Check your mobile service provider if you have questions about your service plan.
4. We will not be liable for any delays in the receipt of any SMS messages as delivery is subject to effective transmission from your network operator.

You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the service and pursue any appropriate legal remedies. You can cancel your receipt of all this service messages by sending STOP, STOP ALL, UNSUBSCRIBE, END, or QUIT to any text message you receive or to the shortcode 88555.

800weather and you agree to arbitrate all disputes and claims between us. This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to:
References to "800weather," "you," and "us" include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of Services. You agree that, by entering into this Agreement, you and 800weather are each waiving the right to a trial by jury or to participate in a class action. This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement.
A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute ("Notice"). The Notice to 800weather should be addressed to: Dispute Resolution, 800weather, 93 S. Jackson Street, Suite 19565Seattle, WA 98104 ("Notice Address"). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). If 800weather and you do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or 800weather may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by 800weather or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or 800weather is entitled.
